CPR 35.3 — independence is the point
Like the calculation service, the expert report is independent of the outcome. CPR 35.3 makes the expert's duty to the court, overriding any obligation to the instructing party. That independence is what makes the report admissible — and what makes it carry weight in mediation and at trial.
