1. This appeal, filed on 28 July 2025 against a decision of the Respondent, dated 2 July 2025, to remove the Appellant’s name from the Register of Approved Driving Instructors, pursuant to section 128(2) of the Road Traffic Act 1988 , as amended, as he had failed to pass a Standards Check test on 11 July 2018 and had failed to attend for Standards Check tests on 26 March 2018, 6 March 2019, 23 September 2019, 16 December 2022 and 26 February 2025, is now a complete appeal.

On 17 October 2025, I issued Case Management Directions, directing the Appellant to advise, within 14 days, whether he wished to continue with his appeal, but also advising that the appeal may be struck out, pursuant Rule 8(3)(b) of the Tribunal Procedure (First-tier Tribunal) (General Regulatory Chamber) Rules 2009) (‘the Rules’) (failure to co-operate with the Tribunal) or Rule 8(3)(c) of the Rules (no reasonable prospects of success), subject to the Appellant’s right to make representations, within 14 days, as to why the appeal should not be struck out. No representations were received.

3. On 19 November 2025, a judge directed that the Appellant be given a further two weeks to respond and to refer to a GRC Registrar after 3 December 2025 with any response or, if no response, to consider striking out the appeal. Again, no response was received from the Appellant. The appeal was, in fact, re-referred to me.

4. The Appellant is again reminded that the Tribunal, on appeal, has no jurisdiction to alter the results of a Standards Check test or to order a re-test. If the Appellant wishes to challenge the outcome of a Standards Check test, he must make application to that effect to a Magistrates’ Court.
